Trademark Restoration
Trademark restoration is the process of restoring the trademark again in the trademark register after the expiry of trademark renewal deadline. After completion of trademark restoration process, the trademark is again added to the trademark register for next 10 years. Trademark restoration provides the same legal protection as trademark registration and renewal.
The process of trademark restoration starts after the expiry of the trademark renewal date. An individual or entity can apply for trademark restoration anytime within 6 months to 1 year after the expiry date of trademark renewal. After the restoration process, trademark becomes valid for the next 10 years.
Form TM-R is used to file trademark restoration application. Both renewal (with surcharge) and restoration fees are applicable in this case.

Trademark Restoration Process
The process of trademark restoration is as follows –
The first & the foremost step to restore your trademark is to file an application in the form of TM-R after the expiry of trademark renewal date. It can be filed to the registrar within 6 months to 1 year after the expiration of trademark renewal date.
After filing the form TM-R to the registrar with the renewal and restoration fees along with the required documents, all the documents are checked by the registrar. Objections may imposed by the registrar in case of restoration of trademark.
After checking all the required documents, registrar approves the restoration application and sends the intimation of the same to the applicant for the trademark publication in the trademark journal.
The trademark is again added to the register of trademark (If application is filed after 6 months of the expiry date of the trademark renewal) which completes the trademark restoration process.
