FCRA Registration in India
As per section 6(1) of foreign contribution regulation act (FCRA) 2010, every society, charitable trust and section 8 company that receive donations or contributions from foreign sources are required to obtain registration under this act. Registration under the foreign contribution regulation act, 2010 is known as FCRA registration. This law is implemented by the ministry of home affairs, government of India. The government has laid down certain rules & regulations for such transactions to discourage the illegal activities which can be harmful for the national security of our country.

Points To Be Considered Before Applying For FCRA Registration
Before applying for FCRA registration, the applicant must be cautious and take these following points into consideration –

Eligibility Criteria For FCRA Registration
As you know, FCRA registration is a mandatory requirement for receiving any kind of foreign contribution. Now, we have to discuss who is eligible to apply for FCRA registration. The applicant applying for FCRA registration must be a non-profit organization registered & operating under any of the following –
In addition to organizational registration, following pre-conditions are also required to be satisfied by the applicant to receive foreign contributions –

Online FCRA Registration Procedure
The procedure of online FCRA registration is given below –
Go to FCRA online portal (https://fcraonline.nic.in/home/index.aspx)
Click on “FCRA online forms”
On the next screen, click on “application for FCRA registration” which will redirect you to the next page.
In the fourth step, you have to select “Click to apply online” button to apply for FC3 (form) registration.
In the fifth step, click on sign up to make your new username and password.
In the sixth step, enter data into all the mandatory fields and click on save.
After clicking save, you will get the message “User-id is created and your User-id is ………….”
In the eighth step, enter your newly made user ID & password and login to your account.
Select option “I am applying for” and choose FCRA registration from drop down menu. Click on apply online.
Click on “Proceed registration”
In the eleventh step, click on FC3 menu in the title bar to start the procedure of new registration.
In the twelfth step, the association form will be displayed and applicant needs to fill the mandatory details of the form along with the required documents –
Click on submit button
In the step 14, click on executive committee option from the menu bar and go to executive committee form.
In step 15, you have to enter all the details of executive committee
Select “add details of key functionary”, you can now add/delete/edit the details you entered in executive committee.
To add further foreigner details, select the record checkbox and click on add/view button.
In the step -18, new screen will be displayed. You can also edit or delete the record by clicking on the appropriate option.
In step-19, you need to enter the EC details by selecting the option from the menu list.
After entering all EC details, click on save button
In step 21, you need to provide the bank details such as bank name, account number, IFSC code, bank address.
To provide all the other information, click on other details option.
You need to upload all the required documents in the pdf format in step 23.
In the step 24, you need to click on the final submission button on the menu bar after entering the place & date.
After submission, a pop up window will appear. Click on ok.
In step 26, click on “make online payment” button on the menu bar, the payment screen will be displayed.
Click on the continue button to do the payment. A pop up window will appear on the screen. Choose the payment gateway and click on payment.
NOTE – After making submission, you cannot modify any of the application details.

Validity Of FCRA Registration
FCRA registration is valid for a period of 5 years and not for lifetime. There are two cases for which the validity period is given below –
FCRA registration
The validity of FCRA registration is 5 years from the approval date. After the expiry period, it will be renewed to receive any further foreign contribution.
Prior permission
Validity period is 5 years from the approval date. Validity will not expire until the foreign contribution is fully utilized for which the prior permission is granted.

After the expiry of FCRA registration, organization needs to file a renewal application for which the timelines are given below –
Cancellation Of FCRA Registration
FCRA registration may get cancelled by the authorities in case the operations of the organization are not as per the provisions of the law. In the last 4 years, more than 4000 FCRA registrations have been cancelled due to non-compliance of provision. There are many reasons by which FCRA registration can become cancelled. The few of the reasons are mentioned below –
Return Requirement After FCRA Registration
After successfully registering your organization with FCRA, the organization use form FC-4 to submit their returns annually.
After registration, organization records all the foreign contributions received and submit form FC-4 online to file a return annually. In addition to the online application form, organization needs to submit the scanned copies of the following documents certified by CA –
- Income & expenditure statement
- Balance sheet
- Statement of receipt of foreign contribution
- Payment made by the entity
Application form FC-4 is needed to be filed along with the required documents within 9 months of the closing of every financial year i.e. 31st December of every year.
